Rich King, Senior Vice President of Stewart Title, discussed the current COVID-related impediments to having instruments executed outside of the United States (lockdowns and closures of public offices). After a short list of statutory authority which included Real Property Law Sections 301, 301-a, 309, 309-a, 309-b, 311, followed by a discussion of what is and what is not “Outside the United States” for notarial purposes, a description of the mechanics of getting this accomplished followed. This included the use of Military Bases for active service members, services available at the US Consulates and Embassies, and particularly the use of the Apostille process in those countries who have signed on to the Hague Convention Abolishing the Requirement of Legalization for Foreign Public Documents.
